High court decision that the revoking of RSS was unlawful
The High Court today ruled that Eric Pickles, the Secretary of State for Communities and Local Government, was unlawful in unilaterally revoking the regional planning strategies in July.
Cala Homes (South) Limited issued a claim for judicial review in August. It is open to the Secretary of State seek to appeal today's high court decision and it will be interesting to see if he will look to appeal the decision. He may be content to wait to abolish the RSS through primary legislation in due course.
If no appeal is made, or the subsequent appeal is unsuccessful (or now, whilst the High Court decision stands) , there are likely to be series of new applications to get permissions through the system before the RSS can be formally revoked through legislation.
